Terms and Conditions

1. Identity and scope

These terms apply to all quotes, services (gilding, restoration, decorative painting, installation) and sales of materials by MercesArtGolden trade and services B.V., H. de Lintweg 63, 3201 EK Spijkenisse, Nederland, KvK 42169061, BTW NL870017688B01, commercial@mercesartgolden.com, +31 6 57567824. Specific conditions written in an accepted quote take precedence over these terms.

2. Quotes and contract

A request made on the website is a request for a quote and does not bind either party. The contract is formed when the client accepts the quote (in the client area or in writing) or when we confirm an order in writing. Each quote is valid for the period stated in it. Additional work requested during a project is quoted and agreed before it is carried out.

3. Prices and payment

Prices are in euros. For consumers they include VAT; for businesses the quote states whether VAT is included. Shipping and travel costs are shown before the order is placed. Payment is made by bank transfer or through the online payment link we send (Mollie or Stripe), within the terms of the quote; for services we may ask for an advance payment. Late payment by businesses incurs the statutory commercial interest.

4. Delivery of materials

Delivery times are indicative; if we cannot meet them, we will let you know and consumers may cancel free of charge. Risk passes to the consumer on delivery. Please check the order on receipt and report any damage or missing items as soon as possible.

5. Right of withdrawal (consumers)

A consumer who buys materials at a distance has 14 days from receipt to withdraw from the contract without giving any reason. Simply tell us by email at commercial@mercesartgolden.com or use the model form below. Return the items within 14 days, in good condition and, where possible, in their original packaging; the cost of return is borne by the consumer. We refund the amount paid, including standard delivery costs, within 14 days of being notified, and may wait until the items have been received.

The right of withdrawal does not apply to items made or cut to the client’s specifications, nor to services fully performed with the consumer’s express consent. If a consumer asks for a service to begin during the withdrawal period and then withdraws, they pay for the part already performed.

6. Performance of services

The client ensures access to the site, the necessary permits and the agreed working conditions. Work at height is carried out with certified equipment and professionals, in accordance with the safety rules of the country where the work takes place. Delays caused by site conditions or by changes requested by the client may adjust the schedule and price, by agreement.

7. Warranty

Materials sold carry the statutory guarantee of conformity. Restorations carry a 5-year warranty, provided the conservation instructions supplied are followed. The warranty does not cover damage caused by misuse, accidents, exceptional weather, disasters or work by third parties.

8. Liability

Towards businesses, our liability is limited to the amount invoiced for the work concerned, except in the case of intent or gross negligence, and does not extend to indirect loss. Nothing in these terms limits the rights the law grants to consumers.

9. Force majeure

We are not liable for delays or failures caused by circumstances beyond our control, such as weather that prevents safe work, access or travel restrictions, or supplier failures.

10. Intellectual property

The texts, photographs, drawings and decorative designs on this website and in our quotes belong to MercesArtGolden and may not be reproduced without permission.

11. Complaints and governing law

Complaints should be sent to commercial@mercesartgolden.com with a description of the problem; we reply within 14 days. Dutch law applies. Disputes are submitted to the competent court in Rotterdam (Rechtbank Rotterdam), without prejudice to the mandatory protection the law of the consumer’s country of residence affords them.
